Customer hereby applies to American Power Electrical Supply. (“American Power Electrical Supply”) for Credit, and should Credit be granted, Customer agrees to be bound by American Power Electrical Supply’s Terms and Conditions of Sale: Terms are Net if paid within thirty (30) days. If an account is past due, American Power Electrical Supply shall have the right to place the account on C.O.D. Customer agrees to pay to American Power Electrical Supply service charges in the amount of two (2%) percent per month on any past due account balances. In the event American Power Electrical Supply places the account for collection, Customer agrees to pay all of American Power Electrical Supply costs of collection and collection fees, including, but not limited to, attorney’s fees in the amount of the greater of: (a) twenty (20%) percent of the outstanding indebtedness, or (b) Two Thousand ($2,000.00) Dollars, and court costs.
The above signed individual who is either the applicant or a principal of the applicant, recognizing that his or her individual credit history may be a factor in the evaluation of the credit history of the applicant, hereby consents to and authorizes the use of a consumer credit report on the undersigned by American Power Electrical Supply, from time to time as may be needed, in the credit evaluation process.
WE CERTIFY THAT ALL THE INFORMATION ON THIS APPLICATION/AGREEMENT IS CORRECT; AND THAT WE FULLY UNDERSTAND AND ACCEPT AMERICAN POWER ELECTRICAL SUPPLY TERMS AND CONDITIONS OF SALE WHICH CAN BE FOUND AT WWW.AMERICANPOWERES.COM. A COPY OF American Power Electrical Supply TERMS AND CONDITIONS OF SALE WILL BE SENT TO CUSTOMER BY REGULAR MAIL, FACSIMILE OR EMAIL UPON REQUEST.
A FACSIMILE OR ELECTRONIC SIGNATURE SHALL HAVE THE SAME FORCE AND EFFECT AS AN ORIGINAL SIGNATURE AFFIXED HERETO.
AUTHORIZATION TO RELEASE ACCOUNT INFORMATION: THIS WILL ALSO SERVE AS AUTHORIZATION TO ANY THIRD PARTY TO RELEASE INFORMATION TO AMERICAN POWER ELECTRICAL SUPPLY FOR THE PURPOSE OF DETERMINING CUSTOMER’S CREDIT STANDING AND FINANCIAL RESPONSIBILITY.
GUARANTEE: THE ABOVE SIGNED, JOINTLY AND SEVERALLY, HEREBY PERSONALLY GUARANTEE, ABSOLUTELY AND UNCONDITIONALLY, AND AGREE TO BE PERSONALLY LIABLE FOR THE PAYMENT OF ANY AND ALL INDEBTEDNESS OF CUSTOMER TO AMERICAN POWER ELECTRICAL SUPPLY. IT IS UNDERSTOOD THAT THIS GUARANTEE IS CONTINUING AND IRREVOCABLE.
